House File 2671 An Act relating to local government by modifying provisions
related to franchise fees and by creating a pilot city program to establish efficient growth, authorize revenue sources other than property taxes, and provide city property tax relief through property tax credits. This bill would have allowed cities to charge impact fees and additional local taxes to assist in ‘buying down’ the commercial property tax burden, however, not all of the tax revenue generated would have gone to property tax relief.

House File 2392 Water lien bill – changes current law so that a buyer is not responsible for the seller’s water bill - the bill states that the lien must be filed prior to transfer in order to be enforceable. The bill also extends the time period for a landlord to file a tenant’s name with the municipality to establish that a lien is not the landlord’s – current law gave them 10 business days to file and now the landlords will have 30 business days.

House Study Bill 645/ Senate Study Bill 3146 An Act requiring lessees of certain real estate to file the lease with the county assessor and providing a civil penalty.

Senate File 2250 An Act relating to the licensure of real estate brokers and salespersons. This legislation allows a criminal history background check to be valid for 210 calendar days as opposed to the current 90 days. The legislation also requires the real estate commission to process an application for a real estate license while waiting for the background check to be completed, but the commission will hold delivery of the license until the check is completed. The bill requires that the real estate commission shall revoke a real estate license if a licensee is found guilty of three major license law violations within a three-year period. Such violations include; professional incompetency, fraud in procuring a license, embezzlement, forgery, etc.

Senate File 2246 Support An Act removing the requirement to disclose whether a property is in a real estate improvement district from sellers disclosure form.

** Note: There was an amendment to this legislation mandating lead based paint inspection and remediation on all transfers of real property. The IAR opposed this amendment and it was not adopted.

Senate File 2416 This legislation would have changed the independent contractor status of all real estate licensees. The bill would have classified real estate licensees as ‘employees’ of the brokerages and made them subject to the wage payment and benefit laws as an employee/employer relationship. The IAR opposed this language and the Senate adopted an amendment that exempted real estate licensees and maintained our independent contractor status.

House Study Bill 609/ Senate Study Bill 3147 An Act requiring the licensing of abstractors within the department of commerce, establishing fees, penalties, and judicial remedies, and providing an effective date.

House Study Bill 594/ Senate Study Bill 3107 This bill creates the homeowners' consumer protection fund,provides for the assessment of a surcharge, and makes an appropriation. The bill provides that a surcharge of $5 shall be collected by the county recorder at the time of recording a mortgage or deed of trust in addition to any other fees required by law.
